1. Eligibility and Driver Requirements

• Age: The minimum age for renting a vehicle is 21 years, and the maximum age is 75 years. Drivers under 25 years of age may incur an additional surcharge.
• Driver’s License: The driver must hold a valid, internationally recognized driver’s license with at least two years of driving experience. A copy of the driver’s license must be presented at the time of rental.
• Additional Drivers: Only drivers listed on the rental agreement are permitted to operate the vehicle. Additional drivers may be added for a fee, and must meet the same eligibility requirements.

2. Vehicle Usage

• Terrain Restrictions: The vehicle is intended for use on Namibian terrain, including off-road driving where conditions permit. The vehicle should not be driven on restricted or prohibited roads. Any damage caused by misuse or driving on unsuitable terrain will be the responsibility of the renter. Our Toyota Quantum Busses are not permitted to be used for off-road driving.
• Geographic Limitations: Vehicles are to be used within Namibia unless prior written consent from the Company is obtained for cross-border travel. Driving into other countries (except by special arrangement) may incur additional insurance charges or void the rental agreement.
• Off-Road Driving: While off-road driving is allowed, renters must respect all local laws, environmental regulations, and protected areas. The vehicle must not be used in extreme weather conditions or on hazardous terrains (such as deep water crossings, sand dunes, or rugged mountain paths) without proper guidance from the Company.

3. Rental Period

• Rental Duration: The rental period begins at the time of vehicle pick-up and ends at the time of vehicle return, as stated in the rental agreement.
• Late Returns: Late returns will incur a charge based on the standard daily rental rate plus any additional fees for delays. The Company reserves the right to report late returns to authorities if not communicated in advance.

4. Insurance and Liability

• Insurance Coverage: All rental vehicles are covered by a comprehensive insurance policy, which includes third-party liability, theft, and damage. However, this coverage may not apply in cases of driver negligence, off-road misuse, or violation of local laws.
• Excess Liability: The renter is responsible for a deductible/excess fee in case of damage, loss, or theft. This excess amount is specified in the rental agreement and must be paid by the renter if applicable.
• Personal Injury: The Company is not responsible for any personal injury or damage resulting from accidents during the rental period, regardless of fault.

5. Fuel and Maintenance

• Fuel: Vehicles are provided with a full tank of fuel and must be returned with a full tank. Failure to return the vehicle with a full tank will result in a refueling charge.
• Vehicle Maintenance: The vehicle will be in good condition, but the renter is responsible for regular checks of oil, water, and tire pressure during the rental period. The Company must be notified immediately of any mechanical issues or breakdowns.
• Breakdowns: In case of a mechanical failure, the Company will arrange repairs or vehicle replacement within a reasonable timeframe. The renter is not permitted to undertake repairs without prior authorization.

6. Road Safety and Equipment

• Road Safety: Renters must adhere to all Namibian road safety laws, including speed limits, seatbelt usage, and traffic rules. The renter is responsible for all fines, penalties, or legal actions resulting from traffic violations.
• Required Equipment: All vehicles are equipped with essential off-road tools, including a spare tire, jack, and emergency supplies. The renter is responsible for maintaining these items during the rental period.

7. Damage, Theft, and Accident

• Damage: The renter is responsible for the repair or replacement of any damaged vehicle parts caused by negligence, misuse, or failure to follow the terms of the agreement. These Include the Windscreen/Windows, Lost or Damaged Keys, Damaged Tires and Interior Damage.
• Theft: In the event of theft, the renter must report the incident to both the Company and local authorities within 24 hours. The renter is responsible for the replacement value of the vehicle if stolen.
• Accidents: In the event of an accident, the renter must notify the Company and local authorities immediately. A police report must be filed for any accident involving damage or injury. Failure to report an accident will result in liability for any associated costs.

8. Cancellation and Modification

• Cancellations: Cancellations made more than 72 hours before the rental start date will receive a full refund, minus a cancellation fee. Cancellations made less than 72 hours before the rental start date are non-refundable.
• Modifications: Any modifications to the reservation (such as extending the rental period or changing the vehicle) must be made at least 48 hours in advance and are subject to availability and additional charges.

9. Indemnity and Liability

• The renter agrees to indemnify and hold harmless the Company, its agents, and employees from any loss, damage, claims, or liabilities arising from the renter’s use of the vehicle.
• The Company shall not be liable for any indirect, special, or consequential damages incurred during the rental period.

10. Force Majeure

• The Company shall not be held liable for failure to provide services due to unforeseen events such as natural disasters, strikes, accidents, or government actions that prevent or delay the performance of the rental agreement.

11. Governing Law and Disputes

• This Agreement is governed by the laws of Namibia. Any disputes arising from the rental agreement shall be resolved through mediation or arbitration in Namibia.
